Consent cannot be presumed, regardless of social situation and even when consent is given it can be withdrawn at any time. There are no grey areas. Sex without expressed consent with a partner, friend or stranger is rape. Inappropriate touching or contact without expressed consent is assault. No matter what the circumstances, any unwanted sexual experience is an offence.
The Hidden Marks Report (2010) revealed that 1 in 4 respondents reported that they had experienced some kind of sexual assault whilst being a student. 5% of those stated they had been raped and 2% faced attempted rape. The majority of reported incidents were of less serious sexual assault such as unwanted kissing, touching and molesting. The term 'less serious' assault does not mean such behaviour is acceptable. Both personally and legally, everyone has the right to live and enjoy themselves safely without fear of rape or assault. The denial of consent is a boundary that must be respected in all instances.
